PROMOTIONS:

Any promotions presented shall be valid IF they are announced on the website, newsletter or marketing material hosted on the website. All promotions expire after the set time that is mentioned in the promotion deals. However, Surplus-auctions have the right to cancel or discontinue any promotional activity at any given time. We can provide free bids to our users at our consent and they will be credited in their account. We also reserve the right to withhold such free bids based on any inappropriate behavior.

Without limitation to the foregoing, you specifically agree that when you use the Website or the Service in any way, you will comply at all times with all applicable federal, state and local laws, statutes, regulations, and ordinances and will not take any action that harms or violates the rights of any person or entity.

BREACH

Without limiting other remedies, Surplus-auctions may immediately issue a warning, temporarily or indefinitely suspend or terminate your membership and refuse to provide Services to you if (a) you breach the User Agreement; (b) Surplus-auctions is unable to verify or authenticate any information you provide to Surplus-auctions; or (c) Surplus-auctions believes that your actions may cause legal liability for you, other users or Surplus-auctions.

NOTICE

Notices from Surplus-auctions to you and from you to Surplus-auctionsmay be given by either email or regular mail. Notice is deemed given 24 hours after an email is sent, unless the sending party is notified that the email address is invalid. If Surplus-auctions uses the US mail to send you a notice, the notice will be deemed given three days after the date of mailing. The Website may also provide notices of changes to the User Agreement or other matters by displaying notices or links to notices to you generally on the Website.

SURPLUS-AUCTIONS.COMPROPRIETARY RIGHTS

The Website and any necessary software used in connection with it ("Software") contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Content contained in sponsor advertisements or information presented to you on the Website may be protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by Surplus-auctions, you shall not modify, rent, lease, loan, sell, distribute or create derivative works based on the Website or the Software, in whole or in part. You will not access the Website by any means other than through the interface that is provided by Surplus-auctionsfor use by the public in accessing the Website.

BID EXPIRATION

Bids are available for 90 days from the day of purchase. The Free Bids must be used within 30 days. If bids have not been utilized within the given time frame, they will be expired and removed from the account.

HOW AUCTIONS WORK

Every time a bid is placed – the price of the item on which the user is bidding will increase by one cent i.e. $0.01 – it also increases the auction time within a 10 to 20 second range The timer will be shown on the selected auction. If the user is the last bidder until the timer ticks to 0 second – The user has won. However, in the course of the running timer since the last bid has been placed – if another user places the bid – the timer resets again and the current user is the last bidder to win the product if the timer ticks to 0 seconds. A bid submitted by the user would be considered as an offer from that user to surplus-auctions.com to conclude a contract to purchase the item. A contract to purchase the item does not materialize until the auction is finished and the last bidder has followed all the steps provided for in this section. The purchase contract will exist between surplus-auctions and the winning bidder has submitted the last qualifying bid of the auction. The countdown time for each of the auctions is shown on the auction details. The auction ends when no more bids are submitted within the remaining time stated on the auction. The user who submits the highest bid and is the last to bid wins the auction. All other bids on the item expire and will not be refunded. The last bidder is determined based on the records in Surplus-auctions.com’s database and it’s the website’s decision regarding the identity of the last bidder shall be final. Auctions may offer the “Buy It Now” option. “Buy It Now” will allow you to receive your spent bids back, if you purchase the same model of an identical item at its retail price. The option to “Buy It Now” will be offered for a limited period of time (usually 3 days after the auction ends) after which the option to “Buy It Now” is permanently revoked. Surplus-auctions.com does not guarantee that the exact model can be sent. We reserve the right to replace the product upon which user bid with another similar item. We set the auction for 24 hour period. After the clock hits 20 seconds – every time a user places a bid – the clock will reset and will keep on resetting until the clock hits 0:00 and the user with the final bid is the winner. An auction can last as long as users keep bidding on the item which would reset the clock. User must be aware that he will not win unless the clock hits 0:00 and he has the final bid. IF these auctions last more than 24 hours then the users should be aware that surplus-auctions has no control in how long these auctions will last due to high volume of users bidding on the product and resetting the clock. However, at a certain point surplus-auctions.com will have the clock drop to 15 seconds and reset every 15 seconds when a bid is placed and if the auction was to proceed further surplus-auctions.com would then drop clock to 10 seconds to try to end the auction as soon as possible. Also Surplus-auctions takes full control in handling the drop in timers – from 20 seconds to 15 seconds to 10 seconds when the bids are placed. We do this to keep the auction exciting and fun for the user’s activity.

 

 

 

 

 

 

 

 

SECOND CHANCES

We are the ONLY portal that will give ‘SECOND CHANCES’’ to every bidder. If you lose on an item – you get back your bids to enter into our second chance auction where you play again with a higher chance of winning. We do this to make sure that our users are winners. We offer different products in our second chance auctions and sometimes we may add a big ticket item in it to surprise our users. All the other auctions do not give back the bids unless there is some promotion but we are attempting to do that so more users can win instead of just the one with the last bid on an item.

 

SPECIFICS

 

 

The following statement is very important for any customer or potential customer of surplus-auctions.com to read and fully understand before using the service:

By registering and using surplus-auctions.com you understand that you are likely to spend more money than you may receive in product value. Most customers using the site gain less in product value measured in monetary value compared to the amount of money spent to win auctions. Do not buy bids or spend money on the site if you cannot afford to lose the money.

 

We attempt fairness and balance in our auctions therefore some new users or users who have lost auctions may receive special promotions, access to special auctions and/or free bids through site features. We are convinced that the entertainment value of participating in its auctions is valued and that paying a premium price for this entertainment value is fair.

 

All payments MUST be made [auction win plus taxes with S&H] – within 7 days i.e. 168 hours of their win. After 168 hours have passed by – you are no longer entitled to the product that you have won. There will be no refund on the bids that you have placed on that product.

 

Only after the product is paid in full – with an amount that has been confirmed after the auction will the user be legally entitled to the product. We can retain the item if not paid in full or in any term agreed by us and the user in written correspondence.

 

In the case of the product being lost or stolen – we will try our best to assist and support our customers upon request i.e. provide tracking numbers, shipping confirmation, sales receipt and all the logistical documents.

 

 

 

RETURN POLICIES

 

All sales are final. We will inspect that the product works before shipping from our office. However, we DO NOT offer warranty or a guarantee on any products but the only warranty that may be available on some products will be from the manufacturer of those products. We will not be accountable for any shipping damages – in such cases, please contact the shipping party. We will try to help with all documentation because we will inspect the items before we send it out. Surplus-auctions may take your non-winning bids and turn into store-credit for you to win some products – such deals are solely based on the money spent.

OTHER THAN THE FOREGOING, NO WARRANTY IS MADE BY SURPLUS-AUCTIONS.COM REGARDING ANY SERVICES OR PRODUCTS PROVIDED THROUGH, IN CONNECTION WITH, OR LOCATED ON SURPLUS-AUCTIONS.COM OR OTHER SERVICES PROVIDED BY SURPLUS-AUCTIONS.COM, AND SURPLUS-AUCTIONS.COM HEREBY EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: 1) ANY WARRANTIES AS TO THE AVAILABILITY, ACCURACY, OR CONTENT OF INFORMATION, PRODUCTS, OR SERVICES; AND 2) ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

CANCELLATIONS

You may cancel your contract within a week in written form (e.g. letter, fax, e-mail) or by returning the items, without stating your reasons.
The period begins no earlier than when the item and these instructions are received. Receipt can be e-mail receipt to the e-mail address provided to surplus-auctions.com

To meet the deadline, it is sufficient to send the cancellation notice or return the item in a timely manner.

DELIVERY

Unless otherwise stated, delivery will be made directly from our warehouse to the address provided by the user. Deliveries are made solely within the 50 states of the United States as well as within the provinces and territories of Canada. Some restrictions or higher shipping costs may apply. We will update you on the S&H costs after your win.

Delivery times vary and any delivery time indicated is provided only as a guide and is not guaranteed. Surplus-Auctions shall be entitled to engage third parties to satisfy its contractual obligations without being required to notify the buyer. Obvious damage to the item or packaging during transport shall be reported to Surplus-Auctions by the winner upon taking delivery but this would clearly be a dispute between the third party and the user. We will not be reliable for the shipping damages. We will help the user at all ways possible to get the matter handled and his claim proceed because we do an inspection of our products by taking pictures and videos of them before they leave out from our warehouse.

Should Surplus-Auctions not be able to deliver the item ordered, Surplus-Auctions shall promptly notify the winner if it can deliver a comparable substitute product that has the same or better features. The winner shall then promptly notify Surplus-Auctions if it wishes to receive this substitute or if it prefers to receive a refund of the final auction end price.
